The Department of U.S. Citizenship and Immigration Services (USCIS) has released a revised Form I-9. This revised form is required to be immediately used by employers to verify a new employee’s entity and to establish an employee’s employment eligibility in the U.S. On the form, the employee attests to his or her employment authorization and presents to the employer acceptable documents evidencing identity and employment authorization. It is the employer’s responsibility to examine the documents presented by the new hire and to determine whether the documents reasonably appear to be genuine and relate to the new hire. Employers are required to retain the I-9 form and be able to present it upon request to authorized government officials from the Department of Homeland Security, Department of labor, or Department of Justice. The I-9 form does not get filed with any government agency but must be maintained by the employer for three years after the date of hire or for one year after employment is terminated.
